BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Resolution No. 21375, encaptioned: A RESOLUTION GRANTING A SPECIAL EXCEPTIONS PERMIT FOR A FINAL PLANNED UNIT DEVELOPMENT ON A TRACT OF LAND LOCATED IN THE 1900 BLOCK OF ROSEBROOK DRIVE AND THE 7500 BLOCK OF GOODWIN ROAD, BEING ON THE NORTHEAST LINE OF IGOU GAP ROAD SOUTHEAST OF DENTON LANE, MORE PARTICULARLY DESCRIBED HEREIN. be and is hereby repealed and that there be and is hereby granted a Special Exceptions Permit for a preliminary Planned Unit Development on a tract of land located in the 1900 block of Rosebrook and the 7500 block of Goodwin Road, more particularly described as follows: Lots 1-38, Rosebrook Subdivision, as shown by plat of record in plat book 55, page 155, ROHC, being the property described in deed book 4680, page 252, ROHC; and part of block I, Subdivision of a Part of the Northeast and Southeast Quarters of Section 11, Township 6 North, or 2 South, Range 3, West of the Basis Line, Ocoee District, as shown by plat of record in deed book T, volume 27, page 621, ROHC, being part of the property described in deed book 4625, page 912, ROHC. Said lots and part of block form one tract beginning on the northeast line of Igou Gap Road 1589.2 feet southeast of the intersection of the northeast line of Igou Gap Road with the southeast line of Denton Lane, said point being the southwest corner of lot 1, said Rosebrook Subdivision, thence northeast 623.16 feet with the northwest line of said subdivision to the northeast line of lot 9, Final Plat Lots 8 and 9, Igou Place Subdivision, as shown by plat of record in plat book 56, page 6, ROHC thence northwest 250 feet with the northeast line of said Igou Place Subdivision, to the northwest line of said block I, thence northeast 456.5 feet with said block line, thence northeast 208.49 feet, thence southeast 75 feet, thence southeast 648.06 feet to the southeast line of said block I, thence southwest 313 feet with said block I, thence southwest 313 feet with said block line to the northeast corner of lot 8, Igou Crossing Subdivision, as shown by plat of record in plat book 55, page 156, ROHC, thence northwest 265 feet with the northeast line of said Igou Crossing Subdivision to the northeast corner of lot 20, said Rosebrook Subdivision, thence southwest 617 feet with the southeast line of said Rosebrook Subdivision to the northeast line of Igou Gap Road, thence northwest 299 feet with Igou Gap Road to the point of beginning. Tax Map No. 159A-B-1 (part), and 159A-F-1-38. BE IT FURTHER RESOLVED, That said Special Exceptions Permit is subject to the following conditions: A. Planning Commission Requirements 1. The plats must be drawn to one of the size and format requirements of the Subdivision Regulations. These are the only sizes and formats the registrar will record. 2. The Chattanooga Zoning Ordinance requires that there must be on-site usable recreation and open space area in P.U.D.'s. These must be separate lots. The proposed plans have no open space and recreation areas and, therefore, do not meet this requirement. 3. The Chattanooga Zoning Ordinance requires that there must be sidewalks or equivalent paved internal circulation in a P.U.D. Therefore, add the following note: "Per the Chattanooga Zoning Ordinance, sidewalks are required on both sides of Igou Crossing Drive and Rosebrook Drive". 4. Show the location of the three existing fire hydrants along Igou Crossing Drive. One is south of lot 44. One is near the lot line between lots 38 and 43 and the other is near the lot line between lots 24 and 25. 5. Show the 25' building setback from outer P.U.D. boundaries in lots 35-37 of Igou Gardens and along the rear of lots 1-38 of Rosebrook Townhomes. The 25' building setback in the rear of lots 38-43 of Igou Gardens can be eliminated since this is not the outer boundary of a P.U.D. 6. Add the following note: Required Building Setbacks 25' from all outer boundaries as indicated 25' from Igou Gap Road R.O.W. 15' from Igou Crossing Drive and Rosebrook Drive except 10 ' for buildings with rear parking and loading Except for the above, no other building setbacks are required, except 10' between free standing buildings. 7. Change "25' Rear Building Setback Line" to "25' Outer Boundary Building Setback Line". Label this line as such on Rosebrook Townhomes. 8. The proposed buildings on lots 3, 4 and 59 appear to be closer than 10' to the street right-of-way. Therefore, change these proposed buildings to be at least 10' from road rights-of-way. 9. Label Igou Crossing Drive as such in the area of lots 12-17. 10. Since number 6 above establishes building setbacks, delete the Setback Requirements from Rosebrook Townhomes. 11. Add the following engineer's statement and have it signed by an engineer: "I certify that I have reviewed or designed all new roads, drainage, domestic water and sanitary sewers as shown on this plat and that the design meets proper engineering criteria." Add the seal of the engineer. 12. Add the following surveyor's statement and have it signed by a surveyor: "I certify that I have surveyed the property shown, that this plat is correct to the best of my knowledge and belief and the ratio of precision of the unadjusted survey is 1"______". Add the seal and address of the surveyor. 13. Add the following owner's statement and have it signed by the owner: "I certify that I am the owner in fee simple of the property shown, adopt this as my plan of subdivision, dedicate the road rights-of-way as shown to the public use forever and certify that there are no encumbrances on the property dedicated". Add the address of the owner. 14. Show adjoining lot lines, lot numbers, subdivision name and plat book and page number of adjoining lots in Igou Crossing Subdivision per Plat Book 55, Page 156 and Igou Place per Plat Book 55, page 158. 15. Show the owners' names and corresponding deed book and page numbers for the R-4 property north of this subdivision and the adjoining property east of lots 1-6 of Igou Gardens. 16. Show and label the center lines of Igou Crossing Drive, Rosebrook Drive and Igou Gap Road. 17. Show the adjoining lot lines, lot numbers and plat book and page number for adjoining lots west of lots 23-32 of Igou Gardens. 0C 18. Show the deed book and page number of the property subdivided and the number of acres subdivided. 19. Indicate that there are to be 98 units and show the density of development. 20. Add the following note: "City Ordinance No. 9942 entitled Storm Water Run-off and Erosion Control shall apply to any discharge of same from this subdivision of property". 21. Show the present zoning east of lots 1-5 of Igou Gardens as R-1. 22. Show the size, location and number of acres drained for the three 18" drainage pipes proposed in Igou Crossing Drive. One is proposed south of lot 44, one at the lot line between lots 31 and 32 and the third is proposed at the lot line between lots 24 and 25. 23. Add 10' drainage easements at the downstream ends of these three drainage pipes. 24. Add the following note: "The City of Chattanooga is not responsible for construction or maintenance of drainage easements". 25. Show 20' sanitary sewer easements where proposed sanitary sewer lines cross lots. 26. Add the following note: "The City of Chattanooga is not responsible for construction or maintenance of any community lot". 27. Add the following note: "Sewer Available". 28. Show bearings, distances and curve data for all road and lot lines. 29. Label the plan as a Final P.U.D. Plan. 30. Show the existing zoning as R-T/Z, RT-1 and R-4. 31. Indicate that adjoining subdivisions east and west of Rosebrook have detached single family houses. Indicate that the property north of Igou Gardens is 0C vacant. Indicate that the property east and west of Igou Gardens is vacant. 32. Add the following note: "Only attached or detached single family houses are allowed on lots". 33. Show the number of areas subdivided. 34. Submit a plan showing the location of water lines. 35. Show the required fire hydrants at the intersection of Rosebrook Drive and Igou Gap Road and at the end of Rosebrook Drive. 36. Show the size, location and number of acres drained for the drainage pipe at lots 12 and 13. 37. Submit and obtain approval by the Planning Commission staff in final form. B. Utility Requirements Show a 10' Power and Communication easement along both sides of Igou Crossing Drive and along the west line of lot 14, the east line of lot 40 and the south line of lot 24.
